DC’s Paid Family Leave Notice

The DC Office of Family Leave Act (§ 32–541.01), established a universal paid-leave program in Washington DC, governed by the DC Office of Paid Family Leave. The DC Office of Paid Family Leave announced that employers have until February 1, 2024, to post the 2024 Notice to Employees and provide a copy to all covered employees. An “employer” under the DC Office of Family Leave Act is any business that performs services in DC and is required to pay unemployment insurance on behalf of its employees. A “covered employee” is either an individual who spends more than 50% of their time working for an employer in the District of Columbia OR an individual who is based in the District of Columbia, spending a substantial amount of time there, not more than 50% in another jurisdiction.

Employers are required to post and maintain the 2024 Notice to Employees in a conspicuous place, in English (or other languages in which the notice has been published). The employer is also required to provide the notice to all covered employees.

The 2024 Notice to Employees contains the following information:

  • Explanation of covered workers;
  • Description of the covered events;
  • Information on the maximum leave entitlements;
  • How to apply for benefits;
  • Benefit amounts;
  • Protections offered to covered workers.
